The purpose of this Privacy Policy is to explain the principles on which MK-RAIL Mateusz Kędziak, based in Ostrów Wielkopolski, collects, uses and protects your personal data, as well as to present your rights in connection with the processing of personal data by the Controller.

The controller of personal data obtained via the website available at https://www.mk-rail.com is MK-RAIL Mateusz Kędziak with its registered office in Ostrów Wielkopolski (63-400), ul. Jodłowa 2, NIP: 622-28-27-571, e-mail: kontakt@mk-rail.com , tel.: 509-419-320.

The Administrator carefully selects and applies appropriate technical and organizational measures to ensure the protection of processed data, including securing data against unauthorized access, other instances of disclosure or loss, destruction, or unauthorized modification of specified data, as well as against processing in violation of applicable law. The Administrator exercises constant control over the data processing process and limits access to data to the greatest extent possible, granting appropriate authorizations only when necessary.

Purpose and basis of data processing

We collect personal data in the following cases:

Contact form – the purpose of data processing (name, surname, telephone number, email) is to respond to your inquiry electronically (via email address) or by telephone (including text messages). Legal basis: GDPR Article 6(1)(b) (handling requests for quotations) or Article 6(1)(a) (ensuring appropriate handling of other inquiries);
Recruitment using forms or emails – the purpose of data processing (CV, cover letters, additional information) is to consider your application in the recruitment process. Legal basis: GDPR Article 6(1)(b) (in the case of ongoing recruitment) or Article 6(1)(a) (consent expressed in the content of the CV and cover letter; if you would like your application to be used in other recruitment processes, please include this in the clause);
marketing of own services and sending commercial information regarding the Controller's activities – the purpose of data processing is for the Controller to send commercial information regarding its offer and promotional materials. Legal basis: GDPR Article 6 paragraph 1 letters a and f;
webinar registration – the purpose of data processing is to organize and conduct the webinar. Legal basis: GDPR Article 6(1)(a);
fulfilling the legal obligations incumbent on the Personal Data Controller. Legal basis: GDPR Article 6(1)(c);
arising from legitimate interests pursued by the Controller or a third party, in particular for the purpose of pursuing, establishing and defending against claims, ensuring IT security, for archival and statistical purposes, as well as for analytical purposes consisting in the analysis of data collected automatically when using the website, including cookies, e.g. Google Analytics cookies, Facebook pixel, Salesmanago.pl, Microsoft Bing Ads, as well as for profiling for marketing purposes, Legal basis: GDPR, Article 6, paragraph 1, letter f.

As part of the website, the Administrator processes the personal data you provide. In some situations, personal data may also be collected automatically using cookies, as described in the cookie policy below.

Please remember that providing your personal data is voluntary, but it is required to achieve the processing purposes described above. Without your data, we cannot achieve these purposes.

The processing of the data you provide that is not mandatory or excessive is based on your decision. Therefore, the basis for the processing of this data by the Controller is your consent (Article 6, paragraph 1, letter a of the GDPR).

Data processing period

Personal data may be processed for the following periods:

in relation to the processing purpose defined in point 1 – for the period necessary to clarify the matter in connection with the receipt of an inquiry via the contact form on the website, and in the case of consent to receive commercial information – for the period necessary for the Controller's business needs. The data will not be processed for longer than 1 year or until the consent to the processing of personal data is withdrawn;
in relation to the purpose of processing defined in point 2 – for the period necessary to carry out the ongoing recruitment process, and if the candidate has consented to the processing of data in future recruitment processes, also thereafter, but for a period not longer than 1 year;
in relation to the purpose of processing defined in point 3 – for the period necessary for the Controller’s business needs, but no longer than 2 years or until the consent to the processing of personal data is withdrawn;
in relation to the purpose of processing defined in point 4 – for the period necessary to organize and conduct the webinar;
in relation to the purpose of processing defined in points 5 and 6 – for the period necessary to achieve the indicated purpose of processing, but no longer than for the period resulting from the provisions on archiving and limitation of claims and tax law provisions.

After the indicated periods have elapsed, the data will be deleted.

Your rights

You have the following rights:

Odbiorcą danych osobowych mogą być upoważnieni pracownicy Administratora danych, podmioty świadczące usługi prawne, zewnętrzni dostawcy usług (np. podmioty świadczące usługi IT, podmioty obsługujące mailing, podmioty świadczące usługi księgowo – podatkowe, inne podmioty przetwarzające dane w imieniu Administratora na podstawie umowy powierzenia przetwarzania danych osobowych), a także podmioty upoważnione na podstawie obowiązujących przepisów prawa (w szczególności sądy i organy państwowe).

Dane osobowe nie będą przekazywane do państw trzecich i organizacji międzynarodowych.

Z uwagi na korzystanie przez Administratora z usług Facebook, LinkedIn, Twitter, Instagram oraz Microsoft Twoje dane osobowe mogą być przekazywane do Stanów Zjednoczonych Ameryki (USA). Portale wykorzystują zatwierdzone klauzule umowne lub stosują mechanizmy zabezpieczeń wskazane w RODO, w stosownych przypadkach, w zakresie przekazywania danych z Europejskiego Obszaru Gospodarczego do Stanów Zjednoczonych i pozostałych krajów.

Administrator może korzystać również z usług Google, który utrzymuje serwery na całym świecie, wobec czego dane osobowe mogą być przetwarzane na serwerach znajdujących się poza Europejskim Obszarem Gospodarczym. Google stosuje mechanizmy zabezpieczeń przewidziane przez RODO.

Administratorem danych osobowych na fanpage (profilu) na portalu społecznościowym Facebook, Instagram, LinkedIn czy Twitter jest MK-RAIL Mateusz Kędziak z siedzibą w Ostrowie Wielkopolskim.

Administrator przetwarza dane Użytkowników, którzy:

dokonali subskrypcji na fanpage’u lub innym profilu na portalu społecznościowym poprzez kliknięcie ikony „Lubię to” lub „Obserwuj”,
opublikowali swój komentarz lub kliknęli ikonę „Lubię to” bądź tożsamą pod którymkolwiek z postów zamieszczonych na fanpage’u (profilu).

Administrator może przetwarzać następujące dane:

podstawowe dane identyfikacyjne (imię i nazwisko) w zakresie opublikowanym przez Użytkowników na ich własnych profilach na portalu społecznościowym,
dane opublikowane przez Użytkowników na profilu na portalu społecznościowym;

Dane osobowe Użytkowników przetwarzane mogą być w następujących celach:

prowadzenia fanpage pod nazwą MK-RAIL na portalu społecznościowym Facebook, w tym w celu administrowania i zarządzania fanpage oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez Facebook Inc., na podstawie art. 6 ust. 1 pkt a oraz f RODO;
prowadzenia profilu pod nazwą mkrail na portalu społecznościowym Instagram, w tym w celu administrowania i zarządzania profilem oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez Facebook Inc., na podstawie art. 6 ust. 1 pkt a oraz f RODO;
prowadzenia profilu pod nazwą MK-RAIL na portalu społecznościowym LinkedIn, w tym w celu administrowania i zarządzania profilem oraz komunikowania się z Użytkownikami, na warunkach oraz na zasadach określonych przez LinkedIn Ireland Unlimited Company, na podstawie art. 6 ust. 1 pkt a oraz f RODO;
ewentualnego ustalenia, dochodzenia lub obrony przed roszczeniami, na podstawie art. 6 ust. 1 pkt f RODO,
badania satysfakcji klientów i określenia jakości produktów oferowanych przez administratora, na podstawie art. 6 ust. 1 pkt f RODO.

Odbiorcą danych osobowych Użytkowników przetwarzanych w związku z działalnością na portalu społecznościowym mogą być:

upoważnieni pracownicy Administratora danych,
podmioty związane z Administratorem umową o świadczenie usług w zakresie zapewnienia funkcjonowania fanpage’a lub innego profilu na portalu Facebook, Instagram, LinkedIn oraz Twitter,
właściciel portalu społecznościowego Facebook i Instagram w zakresie, jaki wynika z zapewnienia funkcjonowania fanpage’a na portalu Facebook i Instagram – zgodnie z regulaminem tego portalu.
właściciel portalu społecznościowego LinkedIn w zakresie, jaki wynika z zapewnienia funkcjonowania profilu na portalu LinkedIn – zgodnie z regulaminem tego portalu;

Dane Użytkowników zostały pozyskane od portalu Facebook, Instagram, LinkedIn oraz z publicznych profili Użytkowników na wskazanych platformach internetowych.

Dane osobowe Użytkowników będą przechowywane przez okres niezbędny ze względu na potrzeby biznesowe Administratora, przez okres prowadzenia fanpage (profilu) lub do czasu, aż Użytkownik zgłosi sprzeciw względem ich przetwarzania, cofnie zgodę – jeżeli dane przetwarzane były na podstawie zgody, lub Administrator sam stwierdzi, że dane zdezaktualizowały się.

Użytkownik posiada prawa wymienione w treści niniejszej Polityki prywatności.

Profilowanie

Administrator nie podejmuje decyzji, które mają skutek prawny lub które wpływają na Ciebie w podobny sposób. Twoje dane osobowe mogą być przetwarzane w formie profilowania w celu realizowania działań marketingowych przez Administratora. Zautomatyzowane przetwarzanie danych pozwala na ocenę wybranych zachowań, tworzenie prognoz zachowań na przyszłość oraz wyświetlanie treści marketingowych.
